Estate Administration

If a person dies with a will, their estate will be administered by an executor or executrix. If a person dies without a will, their estate will be administered by a court-appointed administrator or administratrix. A variety of legal issues could arise during the administration of an estate. Estate fiduciaries have several legal obligations such as properly notifying beneficiaries, inventorying the estate assets, and paying claims against the estate. This process can become confusing and overwhelming while you are grieving the loss of a loved one, and family dynamics can complicate it further.

If you require guidance in fulfilling your obligations as an estate fiduciary, please call today to schedule a consultation.

Trust Administration

While trusts can be a great estate planning tool for many people, they are not free of their own issues and potential pitfalls. Most trusts do not require court oversight, but the law imposes several obligations on trustees in administering a trust. In addition to complying with the law, trustees must also comply with the terms of the trust document. Trustees may also run into issues if beneficiaries' expectations don't align with the trust terms. Some trusts are subject to court oversight, and trustees of those trusts may have to file accountings or request court approval for disbursement of funds.

If you are a trustee seeking assistance in understanding or fulfilling your legal obligations, call today to schedule a consultation. I can help you interpret the trust document, advise you on your legal obligations, draft legal documents, or communicate with beneficiaries on your behalf, among other things.
